Here is a letter to the school board pointing out the meeting was illegally noticed and can not be heard in a closed secession intentionally excluding the public.

RE:9-13-05 Special Closed Session Notice
Your closed session scheduled for today's at 6:00PM violates the Brown Act and is clearly illegal.
I have placed an annual written demand, as an adjudicated newspaper, to receive notices of all meetings. I have accepted the postings on the school's website as notice, even though this doesn't comply with the Brown Act. Tonight's meeting is not on your website, and it was not provided to me as required by law.
Further, the subject of tonight's meeting, the acceptance of Dr. Wagner's resignation, is not allowed under the Brown Act, as she has publicly made notice of her resignation by e-mail to the board and she has given an interview to the AV Press.
Discussion concerning selection of a new superintendent and its timeline is not subject to closed session either, and it must be done in public.
There is nothing more irritating than the continued secret operation of this district by Dr. Wagner even after she has resigned. You as a board must rise to the occasion and refuse to have any closed sessions unless the Brown Act mandates them, and you can start tonight by canceling this improper closed session.
As for a method to select the new superintendent, I am plagiarizing and placing in writing what I have heard from one of the board members. I fully support the position that the selection of the new superintendent is done in a completely open manner and in public before the entire community.
The selection committee should be made up of the school board and the school board candidates for the November election. This group has self-selected themselves to participate in the management of the district, and by definition must all be registered voters in the community. The meetings with the community must be in public, with the public allowed to participate in the questioning of the superintendent candidates.
There is no need to have school staff, union representatives, or the resigning superintendent a member of this committee.
If we are to regain the trust of the community, we must operate in full view of the public, and that is what makes this closed session called by Dr. Wagner such an abomination and an insult to the community.

You are cordially invited to an informational meeting for potential future board members on September 13 at 6:30p.m. in the staff lounge at Acton School. We will end no later than 8:30p.m The purpose of this meeting is for the Superintendent to share information with potential board members regarding the role of board members, and to provide you with general information about the district. This will be offered in a presentation style format, followed by a question/answer session. This is a meeting of the Superintendent, and therefore will not be operating under the Brown Act.
This meeting is not intended as a forum for potential board members to state their platforms or opinions, and no campaigning will be permitted to take place. It is merely an informational meeting designed to assist you in gathering information relative to the role and the district. The meeting is optional. While the public is welcome to any meeting, this meeting is intended for future board members only.
