7.9 Approve Agreement with Leasing Innovative for a Lease-Purchase of the Temporary Gym at Vasquez High School.
It is recommended that the Board review and then approve the proposed agreement with Leasing Innovations for lease-purchase of the temporary gym at Vasquez High School. The terms of the agreement are presented on the enclosure as is the proposed payment schedule. It is the intent of the District to make the payments on this lease-purchase agreement from Developer Fees.

Vasquez Construction Update: Steady progress is being made on the installation of the temporary gym. The concrete foundation and the slab should be completed by January 27. Once that phase is completed, the erection of the gym structure can begin (projected for January 31).

Dr. Banderas then presented an update on the facilities at Vasquez High. The concrete slab for the gym was to be poured January 28 with erection of the structure scheduled to begin on Monday, January 31. Completion of the Drama/Art and the Home Economics Buildings is scheduled for February 7. He announced that more details on the whole Vasquez project will be presented at the February 10 Board meeting when representatives of Osborn Architects will make a presentation to the Board.
School Board Meeting Minutes 2-24-00
Dr. Banderas added that he had made visits to school sites during the deluge of rain on Wednesday and reported that all schools survived the rain with very little damage. In conclusion, he reported that the temporary gym is nearing completion as the workmen have enclosed the structure and are installing backboards and lights.
Mr. Barofsky addressed a need for a policy and/or a procedure to be established before allowing the temporary gym to be used by community members. He suggested that the District consider limiting access to the new gym, as it is not designed for the use of a standard gym.

Dr. Banderas provided an update on the Vasquez project. He indicated that the home economics classroom and the art/drama classroom were completed and occupied by students. The irrigation system and soil preparation work on the football field is near completion and he said we would be seeing green sprouts fairly soon. Work on the gym is also nearing completion. The flooring is the last remaining portion of the job and that work should begin around March 15.

7.6 Adopt Resolution #99-00.14 for a Lease Agreement with Leasing Innovations for the Vasquez High School Temporary Gym.
It is recommended that the Board adopt resolution #99-00.14 to enter into a lease agreement with Leasing Innovations. This agreement is for the temporary gym on the Vasquez High School campus. The terms of this agreement require ten (10) annual payments of $63,134 plus applicable tax. In addition, there are $620 in one-time initial costs and fees included in the first payment. Payments are annual and come due on December 1 of each year.

School Board Meeting Minutes 3-23-00
Dr. Banderas reported that the gym project was at a standstill. He indicated that the firm involved with the lease process has little experience working with schools and some difficulties arose related to wording of the contract. The attorneys are working out the details. He did indicate that the overall construction project was nearing completion. The field is prepared for hydroseeding and workmen are going through some detail cleanup work in other areas of the campus. Over spring break, while students are away from school, a thorough test of all alarm stations and electrical systems will be conducted.

Dr. Banderas reported on the status of the gym by stating that the contract language issues have been resolved and all the paperwork is now in order. A definite timeline for the completion of the project would be determined at a meeting on Monday

7.5 Approve Amendment to the Lease Agreement with Leasing Innovations.
It is recommended that the Board approve the enclosed amendment to the lease agreement the district entered into with Leasing Innovation to fund the procurement and construction of the temporary gym on the Vasquez campus. The bank providing the funding to Leasing Innovation has been hesitant to support the agreement. The bank’s concern is based on the premise that the district might abandon the lease payments on the temporary gym should the district institute some form of alternative funding to construct the permanent high school. Our legal counsel has advised the district that signing the agreement will have no effect on the terms of the agreement. The Board entered this agreement with the full intent to make 10 annual payments or pay off the debt early should funds become available. The wording of the amendment essentially states that the district will meet its obligation regardless of the institution of some form of alternative funding adopted by the district.

Acton Agua Dulce School minutes 5-11-00
Dr. Banderas addressed the gym issue at the high school. He stated that a couple of leaks had been detected during the heavy rains over spring break. The manufacturer has reviewed the situation and a determination is yet to be made as to replacing just one of the three sections on the building or to replace the whole roof. He noted that this process further delays the completion of the project but that it was most prudent to have everything done properly.

Dr. Banderas reported that the contract issues on the gym have been resolved and that the contractor is back on the job. A new timeline will be developed based on the schedule for the replacement of the roof.

Dr. Banderas reported that the gym project is back on track. The roof will be replaced and the vendor stated that it would be done in time for the floor contractor to lay the floor by July 20. The plan is to have the Vasquez Mustang lettering placed on the north gable by the end of summer.

3. Report by the Superintendent
Dr. Banderas reviewed the status of the Vasquez campus development. He reported that the Gym vendor has informed the district that the roof will be replaced by July 21. The flooring installation, which is projected to be a four-day process, will occur. Progress has been made in preparing the food services building and work is scheduled to begin on the electrical and plumbing for the science lab.

It is recommended that the Board approve Change Order #13 in Bid Division #2/#3 (Plumbing/Building Shell) to Neil Edwards for the construction of access ramps to the temporary gym at Vasquez High. The amount of the change order is $17,546.00.

Dulce School minutes 7-27-00
Dr. Banderas reviewed the status of the Vasquez project, noting that the replacement roof had been delivered and that a crew will be on site August 7 to complete the job. Meanwhile, he reported that construction of the gym ramps is underway, and that almost all of the interior electrical work has been completed.

The Superintendent provided the Board with an update on the Vasquez projects. With the exception of main court baskets, the gym is complete. As a matter of fact, the girls’ volleyball team is practicing in the facility. The food services structure is expected to be complete by the opening of school. The dressing room lockers are expected to be on site on August 28. The science labs will not be ready for the opening of school and a completion date is projected for October 1, 2000.
School Board Meeting Minutes 9-14-00
The Superintendent gave the Board a quick review of the status of facilities at the high school. He mentioned that the gym was complete except for the baskets on the main court and that it was very useable for PE classes. He said it was exciting to see the first athletic event in the new gym on Tuesday where the VHS girls volleyball team competed. The football field is complete and the team held its first scrimmage there on September 9th.
