7-31-04 - We have found the EIR for Vasquez. It included a Drainage plan for the site. This plan was approved as part of the EIR processes.
The Board approved Resolution #98-99.12 to adopt this final Mitigated Negative Declaration and Mitigation Monitoring Program on 5-13-99
A large portion of the site and of the land on the east along Escondido Canyon Road is in the 100 year flood plain and is un-useable. The School in its approved EIR prohibited anything in the floodway.
Note the retention basin that was required by the County to protect those downstream was never built.
Lillian Smith in the 7-30-04 issue of the Country Journal Claims the Bal field was on previously approved plans. I guess she has different plans than were approved in the EIR. She than berates myself and Ron Bird for reporting the illegal grading to the County because we were not approved by unnamed community groups. I personally think it was our duty to report them.
On 8-2-04 Ron Bird is making a presentation before the Acton Town Council at their request about the illegal grading and the failure of the school to build the required retension basin at the community club at 7:30pm
7-28-04 - The County issued two “Stop Work Orders” on the illegal grading in the floodway on 7-15-04, and because the District violated the order and continued grading, on 7-19-04.
Dr. Wagner has refused to respond, and when asked by a number of people at the Surplus Property Committee meeting stated “We are regulated by the state, not the County”. Board member Marty Barofsky, who was at the meeting, again claimed “we don't need any permit from the County”. Lillian Smith, who was covering the meeting for the Country Journal asked “Do you have a permit from the state?” and was basically ignored.
The facts are, the County does control grading for all entities, including schools, because FEMA has designated the County of Los Angeles to enforce Federal regulations concerning flood ways and flood plains. Two representatives of the County of Los Angeles met with Wagner on 7-28-04 to reinforce the point that since tampering with a flood way can place people down stream at risk for damages (this includes the Acton School and the church) and a 50 year storm in Acton is not a winter storm, but in fact a summer cloudburst.
7-14-04 Dr Wagner stated today that the installation of playing fields within the floodway was approved before she replaced Dr. Bandaras. She was told is was OK'd by the School Architect and she assumed that all necessary permits had been obtained. She did not verify anything or advise the public or the new members of the board.
