I am making a formal request for a copy of each and every document, E-mail, and writing, which has been distributed, to the board of trustees from the close of the last meeting on 1-8-04 through tonight’s meeting.
You failed to provide this information at the 1-8-04 meeting despite my written request and violated the Brown Act.
Please do not violate the brown act again. Make sure this letter is in the board correspondence and stop hiding your failure to comply with the Brown act from the board.
I specifically want a copy of the E-mail Trustee Barofsky committed to provide each trustee concerning his proposed school restructuring.
Documents that exist in electronic form anywhere within the district’s computers are to be proved to me in the electronic form in which they exist.
I will be at the meeting tonight to pick up the documents and files.
The authority for the request is in the Brown Act as reproduced below:
54957.5. (a) Notwithstanding Section 6255 or any other provisions of law, agendas of public meetings and any other writings, when distributed to all, or a majority of all, of the members of a legislative body of a local agency by any person in connection with a matter subject to discussion or consideration at a public meeting of the body, are disclosable public records under the California Public Records Act (Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1), and shall be made available upon request without delay. However, this section shall not include any writing exempt from public disclosure under Section 6253.5, 6254, or 6254.7.
