Re: Developer Fees and Prop 55
The Community Education Committee met Tuesday, April 6, 2004 as scheduled.
Included on the agenda was the status of developer fees. The District is currently collecting the fees at the year 2000 rate of $2.05. As of January 2004 the Level 1 rate per square foot is $2.24. After reviewing the California Education Code related to these fees it appears the District may also qualify for a Level 2 fee structure that could increase this revenue substantially. Both of these increases require the Board to authorize fee feasibility studies. The costs related to the authorization of these studies will be more than justified by the increase in revenue realized by this action.
It is the opinion of the Committee that the District should act immediately by authorizing the relatively minor study associated with this routine increase to collect the Level 1 fee and then follow that action by exploring the potential for a Level 2 increase.
The Committee also began studying Prop 55. It appears that our District may well qualify for a share in the $2.25 billion “modernization” funds related to the “modification of a permanent structure that is at least 25 years old, or in the case of a portable classroom, that is at least 20 years old, that will enhance the ability of the structure to achieve educational purposes” as well as the $5.2 billion available for new construction. The competition for these funds is fierce. It is imperative that the District takes immediate action on behalf of our community to acquire our fair share of these funds.
As we have expressed before, time is of the essence here. We implore the District to move post haste on these two very important issues.
