Report 7.2 Receive Report from the Surplus Property Committee.

(7-11) In another case of straying from the law, Dr. Wagner wants to terminate the Surplus Property Committee, as she claimed that some of the people on the committee didn’t agree with her and she would have the board remove those people. Unfortunately for her, the State law only allows the board to form the committee and then accept or reject the report. It does not give them the authority to disband the committee or to replace the committee members for any reason.

The disagreements were over the fact that she refused to follow state law, which required the committee to determine what property, if any, was surplus as it’s first act. The committee was supposed to be independent of the school, set it’s own agenda and meetings, which were to be public under the Brown Act.

Wagner ran the committee as her personal fiefdom, meeting on short notice, without public notice or agenda, at times (during the day) people could not attend. She wants her position to be accepted by acclamation by the pro-bond people on the committee, who want to sell the Acton School and waste that resource along with the millions they have already flushed down the toilet .

Wagner has gone ahead without committee or board action, published Public Notice in the AV Press and sent letters to 30 state agencies announcing the Acton School was available for lease or sale. She did all of this without the Surplus Property Committee ever voting once on its report to submit to the school board and without the school board voting to declare the property surplus.

The report from the Surplus Property Committee was actually written by Dr. Wagner, not the committee. The committee has not met in a publicly noticed meeting with a quorum since May.
