Note this written by Dr Linda Wagner and was handed out to the 5 committee members that attended an unannounced (except via E-mail to the committee) meeting on 7-21-04. The meeting was not held as a quorum did not attend.
It appears that she has made the decision of what property is surplus without a committee vote and action by the board.
No vote has been taken at any meeting of the committee as designating any property surplus as required by law(17390a). The Action taken by Dr Wagner of publishing legal notices on 7-13-04 and on on 7-8-05 sending letters announcing the availability for lease was her action biased on no action by the committee. Her stated results of the public do not match recording of the meeting made by a community member. It is odd Dr Wagner labeled this as a draft when she has unilaterally acted without committee action.
This just looks like a fast track to sell the property.

The Surplus Property Committee
The Surplus Property Committee of the Acton-Agua Dulce Unified School District is a group of community members interested in providing recommendations to the Board of Trustees relative to the use of surplus property. These members have met together to discuss the legal obligations of the committee, and have provided comments on each issue in the attached report.
Review the projected student enrollment and other data as provided by the district to determine the amount of surplus space and real property.

Teaching Station Allocation
Following the move of 3 portables each to High Desert and Meadowlark, the following schools expect to have two classrooms each provided for pull-out programs such as music, adaptive P.E., TUPE, Title I remediation, etc. The District does not consider these properties "Surplus Property" because they are used consistently for instructional purposes. We allocate 2 additional rooms per site for this purpose on a regular basis.

The Surplus Property Committee, having heard these recommendations from the public, establishes the following priority list for the use of this property:

Per Ed Code 17464.b.1 and 2:
A legal advertisement was posted in the Antelope Valley Press on July 13, 20 and 27, 2004 for the purpose of publishing the availability of surplus space at the Acton campus. Mailed notifications were sent, per Ed Code requirement, to:

The Regents of the University of California
The Trustees of the California State University
The county offices in which the property is located
We are not aware of public housing authorities in the county in which the property is located.
3b. Provide for a hearing of community input to the committee on acceptable uses of space and real property, including the sale or lease for child care and development purposes under Education Code 17458.
A hearing was held for this purpose on May 27, 2004 as a forum for public opinion regarding the possible lease of the Acton School site. This hearing was conducted by the Surplus Property Committee. The meeting was held at High Desert School at 7:30p.m.
Notification of this meeting was published in the Country Journal prior to the hearing, and was posted at all school sites 72 hours in advance of the hearing.
4. Make a final determination of limits of tolerance for the use of space and real property.
The Acton School site contains 18 classrooms, a library, a multipurpose room, a cafeteria and restrooms. Based on a figure of 30 people per classroom, the use of the property should not exceed more than 540 people at any one time.
With this capacity, however, it must be noted that there are parking concerns at the site. The committee urges the Board to take parking limitations in to account when leasing the site to proposed renters, and that consideration be given to programs that are drop-off and pick-up oriented, as opposed to activities that require substantial long term parking.
Because Acton has community standards, it is further recommended that the community standards be followed closely, with any additional requirements for lighting being compliant with these guidelines.
Due to a possible future increase in student enrollment, the committee recommends that any lease not exceed 5 years in length, and that the property have the availability to be returned for district use as a school site at the termination of that 5 year lease. Therefore, it is our recommendation that the site not be physically altered so substantially as to preclude it from a fairly easy return to use as an elementary school site.
5. Forward to the district governing board a report recommending uses for surplus space and real property.

Acton-Agua Dulce Unified School District hereby provides public notice of the availability of Acton School 'for lease to one or more agencies.
Acton School is located at 32248 Crown Valley Road in Acton, California. The property consists of eighteen classrooms, a library, cafeteria, office space, restrooms and play fields.
Priority will be given to governmental and educational agencies as stipulated by law.

The purpose of this letter is to provide your agency with official notification that the Acton School site is available for lease. Acton School is located in the Acton-Agua Dulce Unified School District. Due to declining enrollment, the district has consolidated sites, and has closed Acton School. As a result of these actions, this facility is now available for lease.
This site is located at 32248 Crown Valley Road in Acton, California. The school contains 18 classrooms, a library, a cafeteria, an office, multiple restroom facilities and play fields. This location will continue to house the Acton-Agua Dulce Unified School District's Offices and transportation department, as well as two Alternative Education classrooms.
Priority for this lease will be given to specific governmental and educational agencies as governed by laws relative to the disposal and lease of surplus property.
