9-7-05 Facilities Committee Review of Proposed 7000 Series Board Policies

Introduction The Facilities Committee has reviewed the proposed 7000 series of Board policies. Although these policies overall are well written there are several areas which we feel need addressing. We have outlined our concerns below.

Areas of Concern BP 7100(a) - third paragraph - first sentence Consider adding “community members” after the word “students'. “Community representatives” is already included in this list, but we feel the list should go beyond representatives.

In this same first sentence consider changing “Superintendent or designee” to either “Board of Trustees, Superintendent or designee” or simply “Board of Trustees”. The question is who do you want to be responsible for informing these groups. In the second sentence consider changing “Superintendent or designee” to either “Board of Trustees, Superintendent or designee” or simply “Board of Trustees”. The question is who do you want to be responsible for forming a facilities committee. The Board of Trustees formed our current facilities committee.

BP 7131(a) - “Notifications” section - first sentence The “or” should be changed to “and”. The backing government code reads as follows:

65971. (a) The governing body of a school district which operates an elementary or high school shall notify the city council or board of supervisors of the city or county within which the school district is located if the governing body makes both of the following findings supported by clear and convincing evidence:

The government code recognizes that either a city council or a county board of supervisors represents an area. As the policy was written simply notifying the local town council would be adequate. For our district the government code clearly indicates the Los Angeles Board of Supervisors must to be notified. The “and” was suggested because although government code does not require it, it is a very good idea to keep our local town councils informed as well as the BOS. AR 7140 - first paragraph The operative question is: what is considered a “construction project”? Is a simple roof replacement a construction project? If so, this clause states a licensed architect needs to be involved. Changing “any construction project” to “any construction project that requires engineering” would clarify this clause.
