The California Regional Water Quality Board has advised me that they have notified you of my complaint concerning your “Wild West Days” and to require you to obtain a waste discharge permit.
My concern on this issue is the discharge of petroleum products that will contaminate the ground water. Your proposed Demolition Derby will dump petroleum products (oil, rubber, and antifreeze, etc.) directly into the ground in violation of the Fish and Game Code Section 5650 (a) states in part:
5650 (a) Except as provided in subdivision (b), it is unlawful to deposit in, permit to pass into, or place where it can pass into the waters of this state any of the following:
(1) Any petroleum, acid, coal or oil tar, lampblack, aniline, asphalt, bitumen, or residuary product of petroleum, or carbonaceous material or substance.
Parking of visitor's cars on dirt areas will cause the same pollution and that is why your CUP 1404 states in paragraph 3. “That all areas used by automobiles shall be paved with asphalt, concrete or macadam type of surfacing;” requires that cars are only parked on paved areas.
Additionally, the flushing of any petroleum products from the runways and parking lots is also prohibited.
The fine for violation is $25,000 per incident.
It would be in your best interest that you not allow these prohibited activities on your airpark. I am enclosing a copy of the Fish and Game Code and my letter to California Regional Water Quality Board.
Be aware there is strong community opposition to regional events that bring in outsiders. If you want to go forward with your planned fly-in community, it might be best to rethink your actions and who your advisers are.
I would be personally supportive of a fly-in community, but many of my contacts in the community want the closure of your airport. I would like to help you make your operation community friendly and see if the “closure” people can be converted to support a fly-in community with reasonable restrictions.
But, I am afraid your “Regional Wild West Days” has only increased the number of residents that want to shut you down.
