Action Plan Outline:

Goals -- To force the Los Angeles County to lapse SP 1404 and to allow the Agua Dulce Airport to operate on a limited temporary permit for a year or until the airport receives a new permit, whichever occurs first. To review and comment on the new permit and its EIR. Prevent extension and continued operation under SP 1404 (a permit that has never had any environmental review, etc.) to index

Mission Statement - To keep the Acton - Agua Dulce area peaceful, quiet and as rural as possible. To keep pilots from flying over the Agua Dulce Elementary School. To require pilots to fly a specific path in both landing and take-off with specific heights based on the distance from the runway, above the community, to minimize noise. To eliminate the use of airspace over Acton and Agua Dulce as an aerial “off-road vehicle park” by prohibiting all aircraft except those that are approved for take-off or landing from flying below 1,000 feet above ground level (AGI) as stated in (FAR19-191). As Agua Dulce is a low noise rural community, require that all the maximum single event noise is less than 85 dbm. to index

The Agua Dulce Airport was established in 1957 for the sole purpose of allowing a few local residents to commute to work and to fly recreationally on weekends. Historically this airport has been a low use airport for local pilots. The other aerial uses, until the current ownership, have been restricted to out-of-town pilots storing aircraft at the airport when space was tight at other Los Angles County airports (again a low use). The current ownership has caused growth of this airport into an aviation destination for out of town users. This has greatly increased aerial traffic to the detriment of this rural community. The current airport proposal will increase the size of the planes that are typical to this airport, including 11-passenger commuter turbo-jet aircraft with a wingspan wider then the runway. to index

Reasoning - The Airport has consistently violated SP 1404, the permit which in plan English in condition 15 and 16 requires the County to revoke the permit.

Over the past four years the airport has clearly been operating in violation of their County land use permit(s). To name just a few of these issues: Construction has occurred without the benefit of an EIR or County building and grading permits. Neither the FAA nor the California Division of Aeronautics have been notified prior to construction, so prior approval was not granted by those governmental bodies Aerobatic flying has occurred repeatedly, local houses have repeatedly been “buzzed” at too low of an altitude, and night take-off and landings have occurred. Actions

1. Los Angeles County Revoke the Agua Dulce Airport's County operating permit(s) immediately.

2. Los Angeles County could allow limited operation under a temporary permit for one year until a new permit is issued.

Temporary permit

Require that the Airport be closed until the owner applies to the California Division of Aeronautics to convert it from a public-use to a special-use airport. Failure to convert from public-use to special-use within 90 days shall void this temporary permit.

Allow pilots who currently have planes based at this airport to continue using their locally based aircraft under this permit. No new planes will be allowed to use this airport until a new permit is granted. If an existing lessee wishes to replace an airplane under this permit, the new airplane must conform to the rules that the prior owner established at this airport, that were in effect in 1992: single engine propeller under 400 bhp , under 7,000 pounds in weight and be limited to 85dbm single event noise limit (SNE). The list of aircraft N numbers, a color photograph of each aircraft that is authorized to use the airport (the based aircraft) will also be made available to the public.

All Aircraft will be limited to SNE limit of 85 dbm at the noisiest location. To enforce this limit the airport will install recording sound level meters at the noisiest location at each end of the runway.

Aircraft landings and take-offs will be logged and their sound levels will be made available to the public. This log shall include the date, time, SNE, along with the N number.

Immediately cease all training and construction until a new permits is granted.

Operations shall be allowed between sunrise and sunset only.

No touch and goes or stop and goes will be allowed. Any single airplane may only make one landing and take-off per hour.

Helicopters shall be prohibited.

The first violation of any rule will result in a public warning letter. The second violation within 60 days will result in a $1,000 penalty and the third within 90 days will terminate that pilot's flying privileges at this airport. For 1 year.

Require that the airport owner be responsible for any and all legal costs that the County shall incur with respect to any litigation and enforcement actions regarding the airport.

Emergency operations shall be allowed for based and non-based aircraft of all type. All rules are suspended in a bonafide emergency.

The temporary permit shall expire one year from the date of issuance, with no extensions allowed.

3. Allow application for permanent permit

The airport owner may apply for a new operating permit with an associated EIR required. To control the airport, the community will elect a 5-person board with half elected for two-year terms. The Airport will pay all costs associated with the election under the election code on the regular ballot. All other permits pending by the airport owner must be integrated into a single permit including his existing application for but not limited to Alcohol sales and to open the swimming pool and associated recreation facilities. to index

Support - All surveys and the public vote in 1995 opposed the current airport. - Very few people are happy about the current airport /so-called Civic proposal. This plan dedicates over 1500 aviation operations per year to visiting pilots. The number of operations for the new affluent based pilots is unlimited. Many of our local pilots will be forced out because they simply cannot afford a new 3,000 square foot hangar. It is estimated that our current local pilots and their occasional visitors generate less than 2,000 operations per year in their small aircraft. We do not need the annoyance of the larger aircraft that the airport's proposal will bring to the community. It is believed that this position will have widespread community support. to index
