MOTION BY SUPERVISOR MICHAEL D. ANTONOVICH AUGUST 9, 2004
For more than forty years a private airpark has been located in Agua Dulce. The Agua Dulce Airpark was authorized in the late 1950's by a County permit which, due to its age, does not include the land-use controls typical of modern-day zoning approvals. Recently a new operator purchased the Agua Dulce Airpark. As a result, a series of construction projects and management changes is causing new and unforeseen impacts upon the surrounding community.
For several months residents in the Agua Dulce community have voiced concerns about potentially adverse impacts associated with noise, traffic, storm-water run-off, and dust. Many residents believe that these impacts intrude upon the otherwise peaceful lifestyle associated with their relatively low-density, quiet, equestrian community. Of particular concern are the impacts associated with filming by the entertainment industry, which is permitted separately by the Entertainment Industry Development Corporation.
Investigations by County code enforcement staff have identified a series of violations of County permit conditions at the Agua Dulce Airpark. As a result the County has issued several notices of violation to the operator of the Agua Dulce Airpark. As an additional precaution the Department of Regional Planning recently retained an outside monitor to inspect the Airpark on a regular basis and issues written reports concerning compliance with County conditions, codes, and procedures. Given the changes occurring at the Agua Dulce Airpark, the lack of adequate controls in the underlying permit, the pending notices of violation, and the steady chorus of concerns expressed by residents of Agua Dulce, it is clearly time for County decision-makers to conduct a public hearing to review these matters and determine if additional conditions are warranted.
I, THEREFORE, MOVE that the Board of Supervisors
· Direct the Director of Regional Panning to take the steps necessary to conduct a modification/revocation hearing for the Agua Dulce Airpark.
· Direct that the Regional Planning Commission hold a noticed public hearing in or near the Agua Dulce Community at the earliest date possible. The hearing shall be conducted at a location and time convenient to Agua Dulce residents, and Regional Planning staff shall consult on these details with representatives of the Agua Dulce Town Council and the Fifth District.
· Direct the County Counsel, the Department of Public Works to assist the Department of Regional Planning in researching all permit/code compliance issues relative to the Agua Dulce Airpark, and to further assist Regional Planning in the preparation of a staff report for this hearing.
· Request that the Entertainment Industry Development Council (EIDC) review the impacts associated with film shoots at the Agua Dulce Airpark and suggest potential corrective conditions that the Regional Planning Commission can consider during the modification/revocation hearing.
