At the Agua Dulce Town Council Meeting, October 23, a motion was made and passed to not allow candidate Michael Sullivan to run for Council this year based on information submitted to the Agua Dulce Town Council by the chair of the election committee. He was ineligible to run under the Charter and Bylaws, as he had not been a registered voter in Agua Dulce for at least one year. At a special meeting held November 3,, a motion was made to rescind the council decision and the motion was defeated.

At the Agua Dulce Town Council meeting November 13, as first order of business, the chair of the election committee rose and gave the results of the election of November 5. Before any business could be discussed and without the agenda being followed, Mike Sullivan rose, disrupting the meeting and called for the assembly to leave the duly instituted Agua Dulce Town Council meeting and join him in another meeting across the room.

Councilors J. Feuerhelm and L. Swanson quit the Agua Dulce Town Council meeting and joined the other meeting. Candidates Art. Brewer and Pat. Sullivan also joined the other meeting. This is documented on audio tape by the secretary of the Agua Dulce Town Council. Because of the noise and unruly behavior, the only Agua Dulce Town Council business completed was to make the motion to accept candidates Art Brewer, Pat Sullivan, and Howard Carlip with a 5 yes, and 2 absent Vote.

These motions still stand.

No new Councilors were sworn in, leaving only Councilors Geri. Dee, Tana Lampton, Dennis. Dee, still seated after J Feuerhelm quit. With no quorum (4), no Council business has been able to be accomplished since that meeting

Mediation was started (without a vote of the Agua Dulce Town Council) through the Voluntary Mediator Services. On the evening of December 3, Mr. Carlip was asked to voluntarily leave the negotiations because some of the other participants said that if he did not, then they would , thereby voiding all negotiations. Mr. Carlip voluntarily left (8pm) as he felt that by so doing, he would be furthering the mediation process in a positive manner. He had been assured by the three remaining Town Councilors, in caucus, that they would stand firm by the Charter and Bylaws, the previous votes and for his candidacy. At 11pm a different agreement was signed by participants T. Lampton, G. Dee, D. Dee, P. Sullivan, A. Brewer, J. Feuerhelm, and M. Sullivan. This agreement overrode the Charter and the pervious votes and allowed Mr. Sullivan to be the accepted candidate. This agreement was rescinded by myself, in writing, the next day and the agreement was VOIDED. I believe Mr. Carlip, as a duly elected representative, was disenfranchised.

On the evening of December 7, a Mediation Results meeting, which was only advertised by a sign in front of the Agua Dulce Hardware Store (Owned by Brewer) was held at the Elementary School. I am told that at this meeting, at which Mr. Carlip and I were not present or noticed, a ceremony was held swearing in M. Sullivan, P. Sullivan, and A. Brewer.

THIS NEW GROUP IS NOT THE AGUA DULCE TOWN COUNCIL!

I respectfully request the County to aid the Agua Dulce Town Council in obtaining Binding Arbitration where all parties can be properly represented.

Please direct all mail for the Agua Dulce Town Council to my address as the old PO Box was at the post office which has now closed.
