Re: Agua Dulce Airport Dear Mr. Schwarze:
You requested an opinion as to the term of approval for the private airport in the community of Aqua Dulce. This airport has-operated since 1959 pursuant to the terms and conditions of the two succeeding special use permits.
Special Use Permit Number 1352 authorized the airport and its established operating conditions in September, 1958. Condition nine of said special use permit provided that the use would terminate on September 1. 1968.
Special Use Permit Number 1404 was-approved October 27, 1959, and provided for expansion of the airport and modification of the earlier conditional grant.
The latter case, Special Use Permit Number 1404, does not prescribe an expiration date, and it does not incorporate by reference. the conditions of the original permit.
We believe that the latter permit effectively deleted and superseded the original permit and all of its conditions.
Therefore, the airport may continue to be used, provided there is continuing compliance with the operating conditions of Special Use Permit Number 1404, which is. the sole authority under which the current airport operations may continue to exist.
