Here is a letter to Regional Planning to request a cease and desist letter.

RE: Agua Dulce Airpark 

Dear Mr. Hartl, We again are seeing Barry Kirschner operating illegal events at his airport, which has been clearly rejected by a majority of the community. The first event is a fly-in lunch on 1-29-05 sponsored for all Cesna 120-140-170 aircraft throughout the state of California. It is posted on the AOPA website.

Several of the community members have complained to the airport which expressed the opinion that these fly-in events are part of a airport's normal day to day operations.

This is totally untrue, as it is advertised as a special event and unquestionably requires a TUP. Depending on the number of aircraft arriving, which could be hundreds, they would probably park them in the illegal tie down area, which is paved in the blue-line stream without any of the necessary permits.

Please issue a “Cease and Desist Order” and send a copy to me so I can publish it in my newspaper.

In addition, the airport still has on its website a continuing special event involving a historic aircraft display on the first Saturday and third  Sunday of each month. This event would also be illegal, as its anticipated 24 events a year would grossly exceed the 6 TUPs available to the airport, if he had no further events.

Thank you very much for the last year of enforcement of what Commissioner Pat Modugno stated:

 "In my 20-some years (in public life), I've seen very few cases as egregious as this one in terms of ongoing violations,"

This is why we are trying to show him he is not above the law. Its time for the Commission to say “enough is enough” and terminate his permit for his outrageous conduct.
