Agua Dulce Airpark

Sup. Antonovich: first, I'd like, for next week, to introduce this following motion.

For more than 40 years, a private airpark has been located in Agua Dulce. It was authorized in the late 1950s by a county permit, which, due to its age, does not include the land use controls typical of modern day zoning approvals. Recently, there's been a new operator of the airpark and a series of construction projects and management changes has caused a new and unforeseen impacts upon the surrounding community. For several months, residents in the community have voiced concerns about potentially adverse impacts associated with the traffic noise, storm water run-off, and dust.

Many believe that these impacts intrude upon otherwise low density, quiet, equestrian communities. Of particular concern are the impacts associated with filming by the entertainment industry, which is permitted separately by the E.I.D.C. Entertainment Industry Development Corporation.

Investigations by county court enforcement staff have identified a series of violations of permit conditions. As a result, the county has issued several notices of violation to the operator of the airpark. As an additional precaution, the Department Of Regional Planning recently retained an outside monitor to inspect the airpark on a regular basis and issue written reports concerning compliance with county conditions, codes, and procedures.

Given the change occurring at the Agua Dulce airpark that may endanger public health and safety to the community, the lack of adequate controls in the underlying permit, the pending notices of violation, the steady course of concerns expressed by the residents that the use of the A.D.A.P. may constitute a nuisance,

It’s clearly time for county decision makers to conduct a public hearing to review these matters and determine if additional conditions are warranted. So I’d move that the Board Of Supervisors next week direct the director Of Regional Planning to take the necessary steps to conduct a modification revocation hearing for the Agua Dulce airport, direct the Regional Planning commission to hold a notice public hearing in or near the Agua [Dulce} community at the earliest possible date.

The hearing shall be conducted at location and time convenient to residents and regional planning staff shall consult on these details with representatives of the Agua Dulce town council in the fifth district, direct the county counsel and Department Of Public Works to assist the Department of Regional Planning in researching all permit code compliance issues relative to the Agua Dulce air park and to further assist regional planning in the preparation of a staff report for this hearing.

Request that the entertainment industry development corporation review the impacts associated with film shoots at the Agua Dulce airpark and suggest potential corrective conditions that the Regional Planning Commission can consider during a modification revocation hearing.
