First, I would like to thank Oscar Gomez for faxing me a copy of the TUP.
I cannot understand why this was issued without my knowledge, as I have a written standing request to be notified whenever Barry Kirshner of the Agua Dulce Airpark Ranch (aka Agua Dulce Airport) applies for a TUP. As you are well aware, there is considerable community objection to the airport under his permit 1404, and under these temporary use permits.
As you know, your boss James E. Hartl met with a number of community members, along with Supervisor Antonovich and his aides on June 16, 2004. What was discussed was the massive violations of the CUP. Additionally the group complained about the airport’s TUP violations, and it was bizarre that no one from the county mentioned that you just approved another TUP. The TUP you just approved makes no reference to the size of the event. It would seem to be limited by condition 3 of permit 1404, which requires that all automobiles must be parked on paved areas.
The TUP procedure requires that all property owners within 500 feet of the property be notified. We have checked with several property owners that are contiguous with the 1404 defined airport and none have been notified. Additionally, I believe this 500 foot requirement extends to beyond all property both operated as an airport and property owned under the same ownership through attribution. In simple terms, the argument that they notified themselves is not going to fly.
Neither the TUP nor CUP either mentions or allows a music festival. While your letter, written May 10th mentions accessory music, it does not even begin to mention the music festival he is advertising with 3 or more bands. In the past, they have wantonly stripped multiple acres of natural vegetation to allow thousands of cars to park on the dirt. Even though you have had a requirement (19) to restore the area to the original condition, that requirement has been ignored in every TUP issued.
We expect the county to rigorously enforce both the CUP and the TUP, and shut down the "music festival" as noted on their web site, which clearly fails to meet the definition of "accessory music". We also specifically want to know the charitable or civic organization that is sponsoring the event, whose name is not mentioned in the TUP, and specific authority from that group confirming its sponsorship of the event.
I am specifically demanding the right to oppose any further TUPs issued that blatantly harass the community with events that are totally unsuited to the existing surrounding usage.
As they have paid a fee to have an inspector on site, we want a contact number to reach the inspector during the event.
Lastly, if you don’t reign in this operation on the 4th of July, then residents in the community will hold the county financially liable for the disturbance of their property rights caused by the event. This includes the quiet and peaceful use of their homes. This is what independence is all about, not fireworks and loud bands.
Please also include my request to see all documentation for their 2004 Harley Davidson Victory Ride, scheduled for September 2004, and his twice a month Historic Aircraft Displays.
