Dear Mr. Green,

We wish to thank your for providing the Department of Regional Planning an opportunity to meet with you and members of the Agua Dulce community on June 16, 2004. In response to the meeting held on that date and the concerns previously voiced by several residents of the Agua Dulce community, my staff has identified numerous issues regarding the Agua Dulce Airport. A list of those issues are enclosed for your review, We are presently investigating these concerns and will report back to you periodically as we resolve specific issues. Please note that the enclosed list is not. Exhaustive. As our investigation of the Airpark continues, additional issues and concerns regarding he operations of the Airpark may surface.

Please review this list and inform us of any items we may have missed. It is our goal to respond to these issues in a timely manner. ISSUES CONCERNING AGUA DULCE AIRPARK

A, permit Inspections and Enforcement

l) What are the operative permits for the Airpark?
2) Is Special permit 1404 valid?
3) What is considered acrobatic or dangerous flying at the Airpark?
4) Is helicopter training permitted at the Airpark?
5) Has there been a lapse of use of the Airpark?
6) Is the pool an accessory use of the Airpark?
7) Is there a limit to the number of aircraft that may land and that may be based at the Airpark?
8) What type of planes are considered jets under the Permit?
9) What is the consequence for failing to correct violations within 30 days?
10) Does he Airpark have or need permits for the new tie-down area, fueling area and the new hangars?
11) What is the permitted height for the hangars?
12) If the actual height of the hangars exceeds the permitted height, what is the remedy'!
13) Has there been impermissible expansion of the Airpark?
14) Is the Exhibit A revision procedure subject to notice and public hearing requirements?
15) Does the adopted County Airport Land Use Man call far the eventual closure Of the Airpark?

B. The New Tie-Down Area

1) Is CEQA review required for the tie-down area?
2) Does the tie-down area affect the blue line stream?
3) Is the tie-down area outside of a permit boundary?
4) Are the legal descriptions of the Airpark on the Site Plan accurate?
5) Has the Department of Regional Planning approved a valid land-use permit for the new tie downs?
6) Do any of the County land-use permits at the Airpark restrict tie-downs to a maximum of 20 planes?
7) Is the new tic-down area located within a flood plain or flood-wav?

C. Filming At the Airpark

1) Is night filming allowed at the Airpark?
2) Are filming permits temporary use permits?

D. Federal Aviation Administration

1) Is the height of the new hangars governed by federal and state Taw and are the hangars in compliance?
2) How high are the constructed hangars?
3) Have noise contours been established for the Airpark?
4) Does the FAA govern nighttime airport operations at the Airpark?
5) Is acrobatic flying at the Airpark exclusively governed by federal law?
6) Are the proposed athletic fields located within the Runway Protection Zone (RPZ)?

E. Environmental Concerned and Water Rights

1) Has the amount of dust from helicopters been evaluated?
2) Does the Airpark comply with Airport Land Use Plan requirements?
3) Is there excessive use of water by the Airpark?
4) Is the Airpark in compliance with the Clean Water Act?
5) Are resource agency permits (441, 402, and 404 permits) required far the new tie down area?
