Dear Mr. Kirshner:

An inspection was conducted at 33638 Agua Dulce Canyon Rd, Agua Dulce, CA to determine compliance with the provisions of Special Permit 1404(5) and Temporary Use Permit 03-020(5). Violations were noticed. Please note Conditions Nos. 11 and 16 of SP1404(5)., which state that:

11. That there be no acrobatics, parachute jumping or other form of dangerous flying conducted at this airport.

16 It is hereby declared and made a condition of this permit that if any condition hereof is violated or #' any other law, statute or ordinance is violated the permit shall be suspended and the privileges granted hereunder shall lapse; provided that the applicant has been given written notice to cease such violation and has failed for a period of 30 days to do so.

Please also notice Condition Nos. 1a and 21 of TUP03-020(5) which state that:

1 a. To ensure public safety during the event, applicant shall coordinate with local pilots who use the airfield operations to ensure that there shall be no takeoffs or landings of aircraft during the event. Applicant shall make appropriate notifications to ensure air traffic does not create a conflict or safety problem during the event,

21. The applicant shall ensure drat appropriate safety measures are taken during the demolition derby. To ensure public safety appropriate barricades shall be placed to protect event participants and bystanders...

Please also notice Los Angles County Zoning Ordinance Section 22,56.1835 requires a temporary use permit for any event extraneous to the operation of the airport such as Wild West Days or the Santa Fly-1n.

It has been reported that planes have been conducting acrobatic maneuvers at this airport. All forms of acrobatics or dangerous flying must cease immediately.

It has been reported that planes took-off and landed during the operating hours of Wild West Days. It has also been discovered that safety barricades were not in place at the time of the demolition derby at the Wild West Days event. These are violations of Temporary Use Permit 03-020(5) and constitute a violation of Special Permit 1404(5).

It was also reported that the Santa Fly-in event was held December 14, 2003 without the benefit of a temporary use permit. This constitutes a violation of Special Permit 1404(5) and the Los Angles County Zoning Ordinance.

The staff report prepared for public hearing incorporates a history of violations on the property. This information is considered along with many other items in rendering a decision of approval or denial of a new permit.

We also wish to advise you that Condition No. 16 indicates the Consequences of non-compliance, and how these unauthorized expansions or uses could affect you current permit and/or any pending/future permits.

We request your cooperation in complying with the requirements of Special Permit 1404(5) and Title 22 of the Los Angeles County Zoning Code. If actions towards compliance with your existing Special Permit are not taken immediately, you may face potential revocation proceedings and/or criminal prosecution. Conviction can result in a penalty of up to six months in jail and/or a one thousand dollar fine, each day in violation constituting a separate offense. In addition to criminal prosecution, you may he subject to a noncompliance fee of $548 and the imposition of further administrative and collection fees totaling approximately $1,918.00.

By receipt of this letter, consider this an order to comply with the above noted conditions within 30 dam. Failure to comply as requested will cause this matter to be referred to the District Attorney with the request that a criminal complaint be filed and/or referred to the Regional Planning Commission for consideration.
