Temporary use permit case no. TUP 03-020 ( 5 )


The TUP was received from regional planning on Monday 9/15/2003 6:40 AM after the event was over. Regional Planning included a number or our requests in the TUP.

The size of the event was not stated and RP claims the 1,500 listed in his application controlled the event.

They permitted the demolition but added these conditions

"15. The property shall be restored to its original condition within 24 hours following the event authorized by this grant." and "Adequate consideration and provisions shall be made by the applicant to handle any fluid spills during the demolition derby event. Applicant shall promptly remove any spilled fluid or contaminated dirt from the site after the event."

We are asking the county with evidence that he complied with these conditions.

RP required him specify to conform with his CUP conditions in 17. "Comply with Special Permit 1404 conditions 5a and 12." These specifically prohibit larger aircraft and helicopters. The Air park violated that condition in the CUP and the TUP by allowing helicopters to land at the event.

The cars parked on the dirt violated the CUP. This requirement was no lifter by the TUP.

We will see what the County intends to do about these violations.


Conditions of approval

1. This permit shall be effective on the date of this grant, unless appealed by the property owner or his representative to the Department of Regional Planning Land Development Coordinating Center.

2. It is hereby declared to be the intent of this grant that if any provision of this permit is held or declared to be invalid, the permit shall be void and the privileges granted hereunder shall lapse.

3. It is further declared and made a condition of this permit that if any condition hereof is violated, or if any law, statute or ordinance is violated, the permit shall be suspended and the privileges granted hereunder shall lapse.

4. All requirements of the County's Zoning Ordinance and of the specific zoning of the subject property must be complied with unless set forth in this permit or shown on the approved (Exhibit "A").

5. Arrangement and provision of all activities shall be in substantial conformance with the approved (Exhibit "A") on file in the Department of Regional Planning.

6. The Agua Dulce Country Fair / Wild West Days at the Agua Dulce Airport are herein approved and authorized to take place at the following times:

Friday, September 12, 2003 from 5:30 p.m. to 12:00 p.m.

Saturday September 13, 2003 from 8:00 a.m. to 12:00 p.m.

Sunday, September 14, 2003 from 8:30 a.m. to 7:00 p.m.

7. The applicant shall make application and obtain necessary approvals to ensure that all permits and provisions of the County of Los Angeles Public Works, Health, Animal Care and Control, Fire and Business License codes are complied with during the event. Applicant will contact each department for said requirements and approvals.

8. Applicant shall ensure that appropriate and adequate security and safety measures are maintained before, during and after the event to the satisfaction of the California Highway Patrol, County Sheriff and/or other affected government agencies.

9. Food served at the event shall meet the requirements of Los Angeles County Health Code Section 11.12.360.

10. A temporary alcoholic beverage permit must be secured from the State of California Department of Alcoholic Beverage Control for alcoholic beverage sales.

11. Adequate provision shall be made by the applicant to ensure adequate sanitary facilities are provided and available during the event. Toilet and lavatory facilities shall be maintained and supplied in compliance with Section 533 of the Los Angeles County Health Code.

12. Applicant shall ensure that adequate provision is made for waste disposal receptacles during the event. Trash, rubbish, garbage and similar wastes shall be kept in containers to the satisfaction of the Health and Fire departments. Trash containers shall be appropriately monitored and emptied when required.

13. Adequate on-site parking shall be made available to event attendees. Traffic and access to the event shall be appropriately controlled and monitored. Adequate provision shall be made by event organizers to ensure appropriate event security. Parking control personnel shall be available at all times during the event to deal with parking, traffic and safety issues. Admission to the event shall be prohibited when on-site parking is full or becomes unavailable. Emergency personnel and emergency access shall be maintained during the event.

14. Applicant and event operators shall be provided adequate setup time prior to the opening of events herein approved.

15. The property shall be restored to its original condition within 24 hours following the event authorized by this grant.

16. The applicant shall provide appropriate information and notification to California Highway Patrol and Sheriff and obtain parade permit from the California Highway Patrol (CHP). A minimum of three CHP officers will be provided for traffic control. Adequate on-site parking and traffic control personnel shall be provided at all times during the event.

17. Comply with Special Permit 1404 conditions 5a and 12.

18. To ensure public safety during the event, applicant shall coordinate with local pilots who use the airfield and airfield operations to ensure that there shall be no takeoffs or landings of aircraft during the event. Applicant shall make appropriate notifications to ensure air traffic does not create a conflict or safety problem during the event.

19. To minimize impacts on surrounding residents there shall be no amplified music outside after 12:00 p.m. Friday night. There shall be no amplified music after 10 p.m. Saturday night. All events shall conclude no later than 12:00 p.m. Friday, 10:00 p.m. Saturday night and 5:30 p.m. on Sunday. Lighting for the event shall be directed onsite to minimize impacts on surrounding neighbors.

20. The applicant shall ensure that an exhibition permit from the Department of Animal Care and Control is obtained as required for the rodeo event. Manure and waste shall be promptly cleaned-up and disposed of.

21. The applicant shall ensure that appropriate safety measures are taken during the demolition derby. To ensure public safety appropriate barricades shall be placed to protect event participants and bystanders. The demolition derby shall take place on Sunday from 2:00 p.m. to 6:00 p.m. and at no other times. Adequate safety measures and personnel shall be provided during the event to protect participants and spectators. The dirt track shall be kept wet to minimize dust and to slow down the vehicles. Adequate consideration and provisions shall be made by the applicant to handle any fluid spills during the demolition derby event. Applicant shall promptly remove any spilled fluid or contaminated dirt from the site after the event. Adequate safety personnel shall be provided during the demolition derby to ensure overall public safety and coordination.

22. Events shall take place at the times indicated on the attached schedule (Exhibit "B").

23. An inspection fee of $150 per day shall be paid to the Department of Regional Planning for each day of the event ($450.00). A zoning enforcement officer will monitor the event to insure compliance with TUP. Inspection fees shall be paid for this approval to become effective.
