Dear Mr. Kirshner:

An inspection was conducted at 33638 Agua Dulce Canyon Rd, Agua Dulce, CA to determine compliance with the provisions of Special Permit 1352(5) and 1404(5). Violations were noticed. Please note Conditions No. 8 of SP1352(5) 12 and 16 of SP1404(5), which state that:

That the number of aircraft be limited to a maximum of 20 planes to be stored at any one time; 12. That this airport be limited to propeller driven aircraft;

16. It is hereby declared and made a condition of this permit that if any condition hereof is violated or if any other law, statute or ordinance is violated the permit shall be suspended and the privileges granted hereunder shall lapse; provided that the applicant has been given written notice to cease such violation and has failed for a period of 30 days to do so.

It has been reported that more than 20 planes are stored at Agua Dulce Airpark at one time. According to Condition No. 8 this is not allowed. Immediately have enough planes removed from the airpark in order to bring the property into compliance with this condition.

It has also been reported that alcohol is being served at the airpark. Sections 22.24.020, 22.24.025, 22.24.120, 22.24.130, 22.24.140 and 22.24.150 of the Los Angeles County Zoning Ordinance do not permit the serving and/or selling of alcohol in an A-2 zone. Cease all sales and service of alcohol immediately.

Upon inspection it was noticed that a pool is under construction on the property. After some investigation it was found that a pool permit, which is issued through Los Angeles County Department of Building and Safety and authorizes the construction of a pool, has not been applied for. Immediately cease construction of the pool. Upon further review, it was noticed that the pool had been deleted from the Exhibit "A" during its most recent revision dated December 13, 1987. A pool can no longer be built on the premises. The "airtel" has also been deleted from the current approved Exhibit "A" and can no longer be built.

It was also noticed that memberships are being sold for use of future planned recreational facilities. This use constitutes a private recreational club and is only allowed when approved by a conditional use permit as stated in Section 22.24.150 of the Los Angeles County Zoning Ordinance. You must cease the advertising of the recreational club and cease the sale of memberships.

It was also noticed that some events from the Agua Dulce Wild West Days, a Fourth of July celebration, a Business Expo, a Beer Fest, a Santa Fly-In and other similar events will be held at Agua Dulce Skypark. According to Section 22.56.1835 of the Los Angeles County Zoning Ordinance, a temporary use permit will need to be obtained prior to holding any of these events.

It has also been noticed that a private community is in the future plans for the airpark. According to Title 21 of the Los Angeles County Code, before subdividing land, the division needs to be approved by a subdivision process. Obtain this subdivision approval before selling the proposed lots.

It has also been noticed that filming takes place on the premises on a regular basis. All filming needs to be in compliance with the regulations set forth in Special Permit 1352(5) and Special Permit 1404(5). Film permits issued by the Entertainment Industry Development Corporation (EIDC) cannot override any requirements of SP1352(5) and SP 1404(5).

Please also note Los Angeles County Zoning Ordinance, Section 22.52.990(E) does not allow the use of banners. Upon inspection banners were noticed on the property advertising memberships for the new pool. Please remove the banners immediately.

We request your cooperation in complying with the requirements of SP1352(5) and SP1404(5) and Title 22 of the Los Angeles County Zoning Code. If actions towards compliance with your existing Special Permit are not taken immediately, you may face potential revocation proceedings and/or criminal prosecution. Conviction can result in a penalty of up to six months in jail and/or a one thousand ,dollar fine, each day in violation constituting a separate offense. In addition to criminal prosecution, you may be subject to a noncompliance fee of $548 and the imposition of further administrative and collection fees totaling approximately $1,918.00.

By receipt of this letter, consider this an order to comply with the above noted conditions within 30 days. Failure to comply as requested will cause this matter to be referred to the District Attorney with the request that a criminal complaint be filed and/or referred to the Regional Planning Commission for consideration.
