Minutes of Agua Dulce Town Council General Meeting 10-23-96

7:40pm President Jim O'Keefe called the meeting to order. All Town Council members were present except Julianne Feuerhelm.

APPROVAL OF MINUTES:

1. Geri Dee MOVED, seconded by Jim O'Keefe, to approve the minutes of 10/09/96. VOTE: 5 Ayes, 0 Nays, 1 Abstain (Henderson).

OPEN FORUM:

1. Vinnie Lampton asked the Town Council to respond to his letter of protest regarding the filing of applications by the Sullivan and Brewer candidates. Jim O'Keefe reads the letter. This issue will be discussed under Old Business.

2. Peg Spry reports on the need for volunteers to man the polling places for the up-coming election. She also suggested that more members of the Town Council get involved in the Water/Nitrate issue facing Agua Dulce. She reports that the County is testing many small water districts in Agua Dulce on a quarterly basis and the results are available for inclusion in our data base. She is concerned that the acceptance of the Sullivan and Brewer candidacy for Town Council violates the Charter and By-laws.

3. Howard Kaplan spoke as a former Town Council member about the fact that Town Council committees only make recommendations, and that the Town Council has final authority in all matters. He was concerned about the possible violation of the Charter regarding allowing Mike Sullivan's application to be accepted this year by the election committee on grounds that the Charter clearly sets out Residency and Registered Voter requirements for running for the Town Council. He asked two questions:

a. How will the community of Agua Dulce view the Town Council if the by-laws are violated in so casual a manner?

B. What will the Town Council do the next time someone in the community needs a last-minute exception to the Charter or the by-laws?

4. Ray Brown reports that, in his conversations with various well-drillers, it is their opinion that 20 foot deep well-seals are more than adequate to protect the public. It would probably be a cost equivalent to redrill a well rather than repair a defective well-seal. Ray volunteers his wells for water testing. Ray was concerned that mitigation efforts won't solve the problem of nitrates and that residents will have spent money needlessly.

5. Howard Carlip reports that in a conversation with Wendy Phillips of the CRWQCB that Wendy is under the impression that there are many old, abandoned Agricultural wells in the community that are improperly sealed and are contributing to the nitrate problem.

6. Howard Kaplan suggest that this is an opportune time to write a letter to the State Department of Highways asking that in the rebuilding of the Antelope Valley Freeway Overpass at Agua Dulce Canyon Road that the freeway fencing be relocated in such a manner that cars and trucks cannot park under the overpass.

Geri Dee MOVED, second by Jim O'Keefe, that Secretary Dennis Dee write this letter with Howard Kaplan. VOTE: 5 Aye, 1 Nay (Dennis Dee)

7. Peg Spry suggests that the Town Council write a Thank You letter to the County for their efforts in creating the Left-Turn lane at Agua Dulce Canyon Road and Sierra Highway.

OLD BUSINESS:

1. There was no disciplinary hearing because Julianne Feuerhelm was not present.

2. WATER COMMITTEE UPDATE:

Lillian Smith reports that the Community Poll is in Rough Draft form and needs Town Council approval before publishing.

Nolan Henderson MOVED, second by Geri Dee, that the Community Poll language and format, as amended tonight, be approved as submitted by the Water Committee. VOTE: 6 Ayes, 0 Nays.

Nolan Henderson MOVED, second by Lianne Swanson, that the Town Council expend up to $200.00 to cover the costs of printing, folding, etc. the Community Poll. VOTE: 6 Ayes, 0 Nays. Julianne Feuerhelm had previously volunteered to pay the costs of mailing the Community Poll to Agua Dulce.

3. PARKS COMMITTEE:

Tana Lampton reports that no committee meeting was held due to illness striking a number of committee members.

4. ELECTION COMMITTEE:

Tana Lampton requests that the Town Council revisit the issue of the candidacy of one of the applicants for Town Council. A lengthy discussion followed regarding the language of the Charter and by-laws candidate eligibility and residency requirements.

Tana Lampton MOVED that the Town Council reject the Sullivan and Brewer applications to run for Town Council on grounds that their applications were not received in a timely manner. Motion DIED for lack of a second.

Geri Dee MOVED, seconded by Tana Lampton, that Mike Sullivan cannot run for, nor be seated on, the Town Council this year because his application violated the Charter in that he had not been a registered voter in Agua Dulce for the required one year prior to his candidacy in 1996.

VOTE: 4 Ayes, 2 Nays (Swanson and O'Keefe)

5. Tana Lampton questioned the status of the Disciplinary Hearing brought against her by Julianne Feuerhelm on May 22, 1996.
