Minutes of Agua Dulce Town Council General Meeting 10-9-96

7:40pm President Jim O'Keefe called the meeting to order. All Town Council members were present except Nolan Henderson. Julianne Feuerhelm arrived late, after the approval of minutes and reading of correspondence.

APPROVAL OF MINUTES:

1. Jim O'Keefe MOVED, seconded by Geri Dee, to approve the minutes of 9/11/96. VOTE: 5 Ayes, 0 Nays.

2. Jim O'Keefe MOVED, seconded by Lianne Swanson, to approve the minutes of 9/25/96, as amended. VOTE: 5 Ayes, 0 Nays.

CORRESPONDENCE:

1. Letter from Robert Gherelli, Director of the California Regional Water Quality Control Board re: State's acceptance of UC Riverside report and implementation of Well-Head Protection Plan.

2. Regional Planning re: Church/Feldman CUP hearing on 12/3/96.

3. Letter from Rick Curtis re: Purchase of PO Cluster Boxes.

Geri Dee MOVED, seconded by Tana Lampton, that the Town Council pay $105.00 towards its share of the purchase of the PO Cluster Boxes. VOTE: 5 Ayes, 0 Nays.

NEW BUSINESS:

1. Cindy Zieglemeyer asked for a clarification of the Election By-Laws regarding the deadline for receiving Candidacy applications. (Voting Procedure pg 2 of 5). There was a long discussion regarding the requirements of the Charter and By-Laws (applications must be received by October 1st) versus actual practice ( postmarked by October 1st).

Jim O'Keefe MOVED, seconded by Julianne Feuerhelm, to clarify the Election By-Laws so that the application deadline in the future will be governed by the Charter and By-Laws (applications must be received by October 1st) as witnessed by a US Post Office Postmark. VOTE: 6 Ayes, 0 Nays.

Tana Lampton MOVED that for this year's election the vote would be controlled by the Charter and By-Laws. Died for lack of a second.

Chair Zieglemeyer stated that Mr. Sullivan had not been a registered voter in Agua Dulce for the last year. There was a long discussion about Police Officers that are registered elsewhere to protect their homes and families. After Cindy stated that the Election Committee had accepted the applications, the plurality opinion was to allow the applications of Art Brewer, Mike Sullivan and Trisha Sullivan (Objection by Lampton).

2. Dick Tracy reports that the Lion's Club is sponsoring the 5K run on Sunday, October 13, 1996 at the Airpark with the money collected going back to the community.

3. Dick Tracy objected to the 9/25/96 minutes referring to the Reineke's representing the Castaic Town Council. Consensus was to change the wording of the minutes of that date to accurately reflect their interests.

4. Art Brewer announced that the Pumpkin Patch would be open behind the Hardware Store starting October 13, 1996 for benefit of the Agua Dulce school.

5. Peg Spry expressed her reservations about tonight's Town Council decision regarding the Election Committee's interpretation of the deadline for applications for candidacy for the Town Council. It was her opinion that the Town Council's decision tonight violated the Charter and By-Laws, that the Charter prevailed over the By-Laws, and By-Laws prevailed over Robert's Rules of Order. As a separate issue, Peg also made it clear that the Town Council, as an incorporated entity, would be solely responsible for anyone hired as a professional by the Water Committee.

6. Dick Tracy recommended that with the ADTC election so close the disciplinary hearing should be either convened before the new Town Council was seated, or it should be withdrawn. After discussion, consensus was that the hearing should be a private meeting of the Town Council and that Jim O'Keefe should set it up as soon as possible.

7. Tana Lampton discussed the Day Laborer situation and its reemergence as a Town Council Issue. She also read and distributed a report on the School Board's Site Selection Committee and its attempt to buy a school site and build a High School to be financed by General Obligation bonds.

OLD BUSINESS:

1. WATER COMMITTEE UPDATE: Julianne Feuerhelm objected to Geri Dee representing the Town Council before the State Water Board meeting without a vote of the Town Council. Lillian Smith stated that the Water Committee (an Action Committee) asked Geri to speak for them and the consensus of the Town Council members attending the Water Committee meetings was to have Geri represent the Town Council.

Lillian Smith reports that the Water Committee has formed a number of Task Forces sub-committees to deal with Education, Community Poll, etc. She also questioned whether Contract Law would allow the Town Council to implement the Well-Head Protection Plan for the community.

After a discussion about the Community Poll regarding the Well-Head Protection Plan, Julianne Feuerhelm volunteered to pay the mailing costs for distributing a Voter Pamphlet to the Agua Dulce Community.

2. FILM COMMITTEE UPDATE: Dick Tracy reports that the "Dante's Peak" film continues to be shot in the community, but that he has received few complaints.

3. PARKS COMMITTEE: Tana Lampton distributed and read a letter from Mike Antonovich in which he states that he was unaware of a proposed Interpretive Center at Vasquez Park. Tana then read and distributed a letter from Rodney Cooper to Carol Long regarding the County's lack of a funds to develop Vasquez Rocks County Park. Tana then read and distributed a letter from Rodney Cooper to Joyce Law regarding the California Heritage Fund Grant program. She also read and distributed the latest Park's Committee minutes. She reports that Trisha Brewer has joined the committee and that Howard Carlip will write a synopsis of Prop A and its affect on local property owners and Vasquez Park.

4. SKATEBOARD COMMITTEE: Julianne Feuerhelm reports that a number of parents will attend the next Town Council meeting to discuss the Skateboarder issue. There was a suggestion for these parents to form a community club and use the school property. Dennis Dee stated that while the Town Council was the proper forum to discuss the Skateboarder issue, he suggested that another community organization take the lead in providing a locale for the young people to ply their sport. In the meantime Dennis suggested that the parents form their Skateboarders Club and then approach Supervisor Antonovich's office about acquiring a piece of property that the County acquired from Tax Delinquencies for use as a Skateboarder Park.
