Minutes of Agua Dulce Town Council General Meeting 5-22-96

7:36 pm President Jim O'Keefe called the meeting to order. All Town Council Members were present.

ANNOUNCEMENTS:

Dennis Dee announced that he is experiencing recording problems with his personal tape recorder. It needs to be replaced but until it is, Dennis asked that everyone speak clearly and loudly so that accurate minutes can be taken.

Jim O'Keefe announced that he had been contacted by Jeff McHaddad of PacBell Telephone regarding a proposed set of new communication towers on Spring Road. This is a different set of towers from those approved for AirTouch Communications at the same site.

Open Forum:

1. Dick Tracy asked what is the Town Council definition and format regarding time limits for speakers at Town Council meetings? He indicated that "Update" speakers seem to have an unlimited time to speak or ramble , whereas "Open Forum" speakers are limited to 5 minutes.

Dick Tracy asked for clarification on what is a quorum for Town Council meetings? He was concerned when there were only 4 Town Council members in attendance at a general meeting and one member left the room to use the restroom or get a cup of coffee. Did the meeting have to be postponed until all 4 members were seated again?

Dick Tracy pointed out that some Town Council members were not present at Town Council meetings on a regular basis, some were leaving early and some were arriving late. Was this indicative of a lack of interest in Town Council business?

Dick Tracy stated that these questions did not have to answered tonight, but should be addressed in the near future.

2. Chuck Brink reported that the Board of Supervisors has authorized a $600,000.00 contract to repair Agua Dulce Canyon Road adjacent to Vasquez Paradise Park. The Board of Supervisors also authorized the replacement of the Bee Canyon Creek bridge on Soladad Canyon Road, just south of the 14 Freeway. The County documents were on the Internet.

3. Rick Curtis stated that the Town Council should have a policy that requires all project promoters to present their proposed projects to the community only at a Town Council meeting.

4. Ray Brown commented that Communication Towers seem to be proliferating, and the Town Council should follow up on the PacBell towers.

5. Art Brewer asked if Regional Planning required these Communications Towers to be at the same site? It was pointed out that the proposed towers will be at the same address as the AirTouch towers, but located about 200 feet away.

Old Business:

INTERTRIBAL POW-WOW: Julianne Feuerhelm brought up a number of questions regarding what authority did Tana Lampton, Parks Committee Chairperson, have in calling LA County Parks and Recreation regarding the June 1st and 2nd Intertribal Pow-Wow. Julianne then distributed and read a number of documents between Tana and the County, and a letter from Brad "Two Bears" Siniard to Julianne Feuerhelm. Julianne stated her position that LA County can do whatever it wants on its own property, and the community has no say in these activities at the County Park. She then accused Tana Lampton of misconduct by violating the Town Council By-Laws on grounds that Tana did not have Town Council authority over the matter, and Julianne wanted a disciplinary hearing about the matter.

Tana stated that the Parks Committee was responding to community concerns about the Pow-Wow, and that she had fully documented and distributed meeting minutes and correspondence to the Town Council in a timely manner. Tana then redistributed the same information and documents to the Town Council.

Julianne Feuerhelm then stated that one of Tana's memo's complained of vehicles parking for miles along Escondido Canyon Road during the 4th of July Activities. Julianne stated that she had been there and there were no cars on Escondido Canyon Road. Many Town Council members objected to this, stating that they had seen the cars and that there were pictures and videos taken of these parked vehicles.

Julianne then stated that a letter had been written by Jack and Mary Wyle to Dr. Herzog regarding the use of his property at Escondido and Agua Dulce Canyon Road for a parking lot, and further stated that she had spoken to Dr. Herzog on the previous Sunday. Jack Wyle objected. Julianne when questioned by Jack Wyle further stated that she had a copy of this letter to Dr. Herzog. She informed Jack Wyle that she got Dr. Herzog's telephone number from Howard Kaplan.

It was then brought to the Town Council's attention that one of the purposes of the Town Council was to review public and private proposals that may affect the community. The Pow-Wow is certainly a proposal that might affect residents of Agua Dulce living in proximity to the park.

Nolan Henderson then responded to Julianne Feuerhelm's accusations against Tana by stating that the Town Council gave Tana Lampton, at the meeting on 4-24-96, discretion to investigate the Pow-Wow event because of community concerns relating to the particulars of the permit for this event and the lack of information about this event from Brad "Two-Bears" Siniard. A majority of the Town Council confirmed that Tana was following Town Council wishes in pursuing the issue with LA County. In view of the above information, Julianne was then asked if she still wanted to pursue a disciplinary hearing against Tana. She responded "Yes!"

Lianne Swanson also stated her position that LA County can do whatever it wants at Vasquez Rocks County Park, and that residents living near the Park knew or should have known this when they bought their property.

Geri Dee stated that Tana had kept the Town Council informed in a timely manner and that Brad "Two Bears" Siniard had not responded to her requests for more information regarding the Pow-Wow.

Penny Furstnow asked from the floor what security measures would be in effect at the Pow-Wow, along with what arrangements were in place for parking, and security?

WATER COMMITTEE:

There was no water committee meeting in the past week.

Jim O'Keefe reported that he had spoken to Wendy Phillips at the California Regional Water Quality Control Board regarding a tentative meeting with her on June 14, 1996 to discuss the community's willingness to accept mitigation for the water issues.

Lillian Smith felt that there was a great deal of confusion about the Water Committee's goals and plans for the community. She asked where does the Water Committee go from here? Jim O'Keefe responded that all Town Council committee's are authorized to gather information, analyze this information and bring it back to the Town Council, and then the Town Council moves forward with a decision. Geri Dee stated that the Town Council already made its' statement to the State on May 8th. She stated that we have to work together and move forward.

Rick Curtis stated that the Town Council needs the consensus of the community before moving forward. Dennis Dee reminded the Town Council that the community was polled many times in the past about sewers and water systems and that each time the community overwhelmingly rejected these solutions. Dennis stated that the community survey in 1994, the Civic Association poll in March, 1996, and the surveys gathered at the May 8th, 1996 Water meeting all confirm this fact. The community has spoken many times on this issue and the Town Council should move forward on the water issue.

Tana Lampton MOVED, seconded by Geri Dee, that the Town Council conduct three meetings next week to discuss water issues, to include the entire Town Council and the Water Committee, on May 29, May 30 and May 31, 1996. VOTE: 7 ayes, 0 nays. Each member was polled by the Secretary to confirm their vote.

A discussion was then held on the goals to be addressed at these water meetings.

The first was how the UC Study can be successfully attacked. The second was whether Ken

Schmidt had copies of successful mitigation techniques from other parts of California or from other states. The third was the possibility of eliciting from Wendy Philips what mitigation techniques would be acceptable to the State. The fourth was a resolution stating that the Town Council was in opposition to sewers and water systems. The fifth was sitting down with the mitigations already suggested and working out a compromise that is acceptable. The sixth was attempting to estimate costs for the mitigation that is adopted.

FILM COMMITTEE:

Dick Tracy reported that there was filming in the last week on Davenport, and no permit was FAXed to Tana. Filming that night included late night explosions. Complaints have been referred to the County Film Office. Dick answered the recent Daily News report asking why there was two film committee's by stating that the Chamber was a pro-business organization that is attempting to draw business into the Community. The Town Council, through its film committee, represents the residents of Agua Dulce regarding filming activites that impact nearby residents. When other communities experience problems, they refer their problems to their police. Agua Dulce is one of only a few rural areas without its own police force to enforce community rules. Dick also pointed out that if our film policy goes into effect at the County Film Offices, the policies would be incorporated into the Permit Process, but Agua Dulce would still have to depend on the sheriff's Department for enforcement.
